Yes. If you have been injured, you should not give up any of your legal rights until you consult with an attorney. Even if you were partially at fault, you still may be eligible for compensation.
Do you do “house calls”?
Yes. We are happy to come to wherever you are for an in-person meeting.
What fees do you charge?
We take nearly all injury or death cases on a contingency fee agreement. This means that we take a percentage of your recovery, and if you recover nothing, you owe the firm no attorney fees. The customary fee is one-third of the recovery, but that fee may be higher or lower depending on the specifics of your case. We do discount fees for cases that settle without the need to file a formal lawsuit.

What is my case worth?

I have been injured in an auto accident, and the person responsible has no money and little or no insurance. What do I do?
Depending on the circumstances, you may be able to recover from your own uninsured/underinsured insurance coverage.
I was injured at work and have received workers’ compensation benefits. Do I still have a legal claim?
Maybe! While the workers’ compensation laws do not allow you to sue your employer or a co-employee for your injuries, you still may be able to sue a third party if that third party was at fault for the injuries.
If I have a legal claim, how will you about pursuing it?
Typically, we will send a demand letter to the other party or that party’s insurance company outlining your claim and demanding a certain payment. If that demand is refused, then we will file a formal legal complaint on your behalf with the appropriate court.
Will my case go to a trial?
Probably not. Recent statistics indicate that fewer than 5% of civil cases go to a trial. However, it is always essential that we prepare each case as if it will go to trial. The Law Office of Ben W. Mediation is a collaborative process by which you and another party work with a third-party mediator who attempts to facilitate a settlement. The mediator does not give legal advice to either party and has no power to impose a resolution. Mediation is mandatory for all contested divorces in Utah. At The Law Office of Ben W. Lieberman, we believe in the mediation process and strongly encourage settlement through mediation. In addition to being a lawyer, Ben Lieberman is also a trained mediator.
I am scheduled to attend mediation. Should I have a lawyer?
It is always advisable to have a lawyer. While we always encourage settlement of family matters without litigation and strongly encourage settlement through mediation, it helps to have a lawyer advise you as to the legal consequences of your settlement.
What fees do you charge?
We typically offer hourly and flat-fee billing divorce or other family matters. Our hourly rates are commensurate with other attorneys in Salt Lake City, Utah. Our flat-fee rates will change depending on the specific issues involved.
