Divorce and Child Custody

If you are getting divorced, you will have an ex-spouse for the rest of your life, and the terms of your divorce will govern that relationship forever. The conditions of your divorce—time with your children, child support, and division of your assets—will probably affect you for the rest of you life. It is often extremely beneficial if not essential to have a lawyer advise you and represent you during this process.

The Law Office of Ben W. Lieberman represents clients in the following areas of domestic law:

Contested Divorce

A contested divorce is where you and your spouse cannot agree on the terms of your divorce. Usually, the source of the disagreement relates to how the marital assets will be divided, whether one spouse will pay alimony to the other, or who will have custody of the children. These can be very complicated issues, and courts have extremely broad discretion to make these decisions, which will affect the rest of your life and the life of your children. We advocate aggressively for our clients in contested divorces so that they can obtain the most favorable outcome financially, the most time with their children, or so that they can achieve whatever other goals they may have

Uncontested Divorce

If you feel you and your spouse could work out a settlement of your divorce without the need to go to court, we can help you think through your options so that you have an agreement that you both can live with. Then, we can finalize your agreement, prepare and file the paperwork, and obtain your official decree of divorce. This option substantially reduces the expenses of divorce—expenses that you could be using to pay for your children’s education or some other worthwhile purpose.

Mediation

Mediation is required for contested divorce and child custody proceedings in Utah. Mediation is a process by which a neutral third-party facilitates the persons involved in a dispute to reach their own agreement to settle the dispute. We represent clients during the mediation process of divorce and child custody disputes.

Child Custody, Parent-Time and Child Support

We handle disputes related to child custody aggressively and ethically. A child custody dispute may arise in several circumstances, but most often it is in connection with a divorce or a divorce decree modification. We help clients fight for what is in the best interests of their children.

Divorce Modification

Divorce decrees are subject to modification where there has been a material change in the parties’ circumstances since the entry of the decree. We assist clients in modifying child custody orders, alimony and child support orders, parent-time orders, relocation, and other provisions of divorce decrees.

Prenuptial and Postnuptial Agreements

Prenuptial and postnuptial agreements have specific requirements that are not applicable to other types of agreements, and they are strictly scrutinized by courts. We draft and review prenuptial and postnuptial agreements, and we ensure that our clients’ interests are protected.
